The following 30 standards are required of all Medicare Durable Medical Equipment, Prosthetics, Orthotics, and Supplies (DMEPOS) suppliers.
1. A supplier must be in compliance with all applicable Federal and State licensure and regulatory requirements.
2. A supplier must provide complete and accurate information on the DMEPOS enrollment application.
3. A supplier must have an authorized individual (whose signature is binding) sign the enrollment application.
4. A supplier must fill orders from its own inventory, or contract with other companies to fill orders from their inventory, or subcontract its services.
5. A supplier must advise beneficiaries of the option to rent or purchase inexpensive or routinely purchased durable medical equipment, and of the purchase option for capped rental equipment.
6. A supplier must notify beneficiaries of warranty coverage and honor all warranties under applicable law.
7. A supplier must maintain a physical facility on an appropriate site.
8. A supplier must permit CMS, or its agents, to conduct on-site inspections.
9. A supplier must maintain a primary business telephone listed under the business name.
10. A supplier must have comprehensive liability insurance.
11. A supplier must agree not to make a direct solicitation to Medicare beneficiaries.
12. A supplier must maintain written proof of delivery.
13. A supplier must respond to beneficiary complaints and maintain documentation for 7 years.
14. A supplier must maintain written policies and procedures covering daily operations.
15. A supplier must maintain personnel who are knowledgeable, competent, and trained.
16. A supplier must obtain proof of delivery signatures or documentation for all equipment delivered.
17. A supplier must accept returns of substandard or unsuitable items.
18. A supplier must disclose ownership and management information as required.
19. A supplier must not convey that they are endorsed by Medicare or any federal agency.
20. A supplier must not use a Medicare beneficiary number for purposes other than Medicare-related activities.
21. A supplier must maintain ordering and referring documentation consistent with CMS requirements.
22. A supplier must comply with the Medicare beneficiary complaint resolution process.
23. A supplier must maintain an inventory management system to ensure timely delivery.
24. A supplier must refrain from offering inducements, rebates, or kickbacks.
25. A supplier must comply with CMS telephone solicitation rules.
26. A supplier must maintain proof of accreditation by a CMS-approved accrediting organization.
27. A supplier must notify Medicare within 30 days of any changes to enrollment application information.
28. A supplier must comply with all Medicare rules, policies, and instructions.
29. A supplier must provide beneficiaries with information on how to contact CMS with complaints.
30. A supplier must provide beneficiaries a copy of these Supplier Standards upon request
